What is 49 CFR Part 382?

It is the Federal Motor Carrier Safety Administration Drug/Alcohol Testing Regulation.

Why is this regulation important?

  • It is in place to protect the safety of drivers and literally everyone who could be impacted by a driver.
  • For those who fail to comply with this regulation, heavy fines are issued!
  • Depending on the severity of the offenses/fines a business could be shut down permanently or temporarily!

Who does this regulation apply to?

  • Commercial Motor Vehicle with a Gross Vehicle Weight rating of 26,001 or more pounds inclusive of a towed unit with a GVW rating of more than 10,000 pounds.
  • A GVW of 26,001 or more pounds.
  • A vehicle designed to transport 16 or more passengers, including the driver.
  • A vehicle of any size that is used in the transportation of hazardous materials which require placards.

What type of fines/penalties were issued in 2012?

  • Metro Atlanta Area- Violation 382.305 $1,990
  • Metro Atlanta Area- Violation 382.301 $2,870
  • Florida-Violation 382.301 DOT Notice of Claim states FMCSA may prohibit X company from operating in interstate commerce until the civil penalty is paid in full and, if applicable the FMCSA registration will be suspended.

What do we see as common violations?

  • Failure to implement a drug and alcohol testing program.
  • Using a driver before the motor carrier has a negative pre-employment CST on file.
  • Company has not distributed DOT compliant policies to all covered drivers.
  • Company has not conducted inquiries for alcohol and constrolled substances information from previous employers.
  • All drivers are not in a random testing pool or the companys random pool is not managed according to DOT standards.
